IV. Conclusion Accordingly, it is ORDERED that Defendant’s Motion to Dismiss (Doc. 21) is hereby DENIED and Plaintiff’s Motion for Preliminary Injunction (Doc. 6) is GRANTED. V. Preliminary Injunction For the reasons stated above, Defendant Melanie Griffin, in her official capacity as Secretary of the Florida Department of Business and Professional Regulation, is hereby ENJOINED from instituting, maintaining, or prosecuting any enforcement proceedings under the Act17 until further order of the Court following a trial on the merits of this case.
